  • The Assisted Reproductive Technology (ART) (Regulation) Act, 2021 was passed by the Parliament in 2021 to\u00a0regulate and supervise ART clinics and banks in India<\/strong>\u00a0to ensure ethical practices, prevent misuse, and safeguard the rights of patients, donors, and children born through these technologies.<\/li>\n<\/ul>\n\n\n\n

    Assisted Reproductive Technologies:<\/strong><\/strong><\/strong><\/strong><\/strong><\/h3>\n\n\n\n
      \n
    • ART refers to a\u00a0range of fertility treatments<\/strong>\u00a0aimed at\u00a0aiding reproduction for couples suffering from infertility or to persons who may wish to have a child through artificial methods.\u00a0\u00a0<\/strong>\u00a0<\/li>\n\n\n\n
    • These arrangements include\u00a0in-vitro\u00a0fertilisation<\/strong>\u00a0(fertilising\u00a0an egg in the lab),\u00a0gamete donation<\/strong>\u00a0(sperm or egg), and\u00a0gestational surrogacy<\/strong>\u00a0(where the child is not biologically related to the surrogate mother).<\/li>\n<\/ul>\n<\/div><\/div>\n\n\n\n

      Key Features of the Act<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/mark><\/strong><\/h3>\n\n\n\n

      Provision of ART services:<\/mark><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h4>\n\n\n\n
        \n
      • The Act defines ART to include\u00a0all techniques that\u00a0seek\u00a0to obtain a pregnancy<\/strong>\u00a0by handling the sperm or the oocyte (immature egg cell) outside the human body and transferring the gamete or the embryo into the reproductive system of a woman.\u00a0\u00a0\u00a0<\/li>\n\n\n\n
      • These include\u00a0gamete donation, in\u00a0vitro fertilization, and gestational surrogacy.\u00a0<\/strong>\u00a0\u00a0<\/li>\n\n\n\n
      • ART services will be provided through:\u00a0\u00a0\n
          \n
        • ART clinics<\/strong>, which offer ART related treatments and procedures, and\u00a0\u00a0<\/li>\n\n\n\n
        • ART banks<\/strong>, which collect, screen and store gametes.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n

          Registration of ART clinics and banks:<\/mark><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h4>\n\n\n\n
            \n
          • Every ART clinic and bank must be registered under the\u00a0National Assisted Reproductive Technology and Surrogacy Registry.\u00a0<\/strong>\u00a0\u00a0<\/li>\n\n\n\n
          • A\u00a0National Registry<\/strong>\u00a0will be\u00a0established\u00a0under the Act, which will act as a central database with details of all ART clinics and banks in the country.\u00a0\u00a0\u00a0<\/li>\n\n\n\n
          • Clinics and banks will be registered only if they\u00a0adhere to<\/strong>\u00a0certain standards<\/strong>. The registration will be\u00a0valid for five years<\/strong>\u00a0and may be\u00a0renewed<\/strong>.\u00a0\u00a0\u00a0<\/li>\n<\/ul>\n\n\n\n

            Boards:<\/strong><\/mark><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h4>\n\n\n\n
              \n
            • The Act provides that the\u00a0National and State Boards<\/strong>\u00a0constituted under the\u00a0Surrogacy (Regulation) Act, 2021<\/strong>\u00a0will also act as the\u00a0National and State Boards for the regulation of ART services.<\/strong><\/li>\n\n\n\n
            • The National Board will\u00a0review and\u00a0monitor\u00a0the Act\u2019s implementation\u00a0<\/strong>and formulate a\u00a0code of conduct and standards<\/strong>\u00a0for ART clinics and banks.\u00a0<\/li>\n<\/ul>\n\n\n\n

              Eligibility criteria for commissioning parties:<\/strong><\/strong><\/mark><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h4>\n\n\n\n
                \n
              • ART services may be commissioned by\u00a0married couples or women<\/strong>\u00a0where:\u00a0\u00a0\n
                  \n
                • the\u00a0woman is between 21 and 50 years of age<\/strong>, and\u00a0\u00a0<\/li>\n\n\n\n
                • the\u00a0man is between 21 and 55 years<\/strong>.\u00a0\u00a0\u00a0<\/li>\n<\/ul>\n<\/li>\n\n\n\n
                • Married couples must also be infertile<\/strong>.<\/li>\n<\/ul>\n\n\n\n

                  Eligibility criteria for donors:<\/strong><\/strong><\/strong><\/mark><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h4>\n\n\n\n
                    \n
                  • A bank may obtain\u00a0semen from males between 21 and 55 years of age,\u00a0<\/strong>and\u00a0eggs from females between 23 and 35 years of age.<\/strong><\/li>\n\n\n\n
                  • The woman may donate eggs\u00a0only once in her life<\/strong>\u00a0and\u00a0not more than seven eggs may be retrieved\u00a0<\/strong>from her.<\/li>\n<\/ul>\n\n\n\n

                    Conditions for offering services:<\/strong><\/strong><\/strong><\/strong><\/mark><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h4>\n\n\n\n
                      \n
                    • ART procedures must be conducted only with the\u00a0written consent<\/strong>\u00a0of the commissioning parties and the donor.\u00a0\u00a0\u00a0<\/li>\n\n\n\n
                    • The commissioning party will\u00a0be required\u00a0to provide\u00a0insurance coverage<\/strong>\u00a0in\u00a0favour\u00a0of the egg donor (for any loss, damage, or death).\u00a0<\/li>\n<\/ul>\n\n\n\n

                      Rights of a child born through ART:<\/strong><\/strong><\/strong><\/strong><\/strong><\/mark><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h4>\n\n\n\n
                        \n
                      • A child born through ART will be\u00a0deemed\u00a0to be a biological child of the commissioning couple\u00a0<\/strong>and will be\u00a0entitled to the rights and privileges available to a natural child<\/strong>\u00a0of the commissioning couple.\u00a0\u00a0\u00a0<\/li>\n\n\n\n
                      • A\u00a0donor will not have any parental rights\u00a0<\/strong>over the child.<\/li>\n<\/ul>\n\n\n\n

                        Offences and penalties:<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/mark><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h4>\n\n\n\n
                          \n
                        • The penalty for offences under the Act is fine between five and ten lakh rupees for the first contravention.
