About<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/mark><\/strong><\/h3>\n\n\n\n

  • The Prohibition of Child Marriage Act was enacted in 2006 to ensure that child marriage is eradicated from within the society. <\/strong>It replaced the Child Marriage Restraint Act, 1929.<\/strong>\u00a0<\/li>\n\n\n\n
  • This Act is armed with enabling provisions to prohibit child marriages<\/strong> and provide relief to victims<\/strong> and enhance punishment for those who abet, promote or solemnise such marriages.<\/strong>\u00a0\u00a0<\/li>\n\n\n\n
  • The Act applies to all India citizens irrespective of religion and residing even beyond India.<\/strong><\/li>\n<\/ul>\n\n\n\n

    Objectives of the Act<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/mark><\/strong><\/h3>\n\n\n\n
      \n
    • The objective of the Act is to prohibit solemnization of marriage <\/strong>where either the groom or the bride is below the marriageable age<\/strong> (18 years<\/strong> in case of girls<\/strong> and 21 years<\/strong> for boys<\/strong>).\u00a0<\/li>\n\n\n\n
    • The law makes child marriages voidable<\/strong> by giving choice to the children in the marriage to seek annulment of marriage.<\/strong>\u00a0<\/li>\n\n\n\n
    • The Act also allows for maintenance and residence for the girl till her remarriage<\/strong> from the male contracting party or his parents.<\/li>\n<\/ul>\n\n\n\n

      Prevention<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/mark><\/strong><\/h3>\n\n\n\n
        \n
      • Child Marriage Prohibition Officers (CMPO)<\/strong> are to be appointed in every state to prohibit child marriages, ensure the protection of the victims as well as prosecution of the offenders.\u00a0\u00a0<\/li>\n\n\n\n
      • The Act provides punishment for those who permit and promote child marriages.<\/strong>\u00a0<\/li>\n\n\n\n
      • The CMPO and District Collector<\/strong> are responsible for sensitisation and awareness creation<\/strong> in the community.<\/li>\n<\/ul>\n\n\n\n

        Protection<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/mark><\/strong><\/h3>\n\n\n\n
          \n
        • The law provides for all support and aid including medical aid, legal aid, counselling and rehabilitation support to children<\/strong> once they are rescued.\u00a0\u00a0<\/li>\n\n\n\n
        • It gives legal status to all children<\/strong> born from child marriages and makes provisions for their custody and maintenance.<\/strong><\/li>\n<\/ul>\n\n\n\n

          Prosecution of Offenders<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/mark><\/strong><\/h3>\n\n\n\n
            \n
          • The law provides for punishment for a male above 18 years of age marrying a child.\u00a0<\/strong>\u00a0<\/li>\n\n\n\n
          • The Act also provides punishment<\/strong> for those who permit and promote child marriages.<\/strong><\/li>\n<\/ul>\n\n\n\n

            Child Marriage to be Voidable<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/mark><\/strong><\/h3>\n\n\n\n
              \n
            • Every child marriage shall be voidable, <\/strong>at the option of the contracting party who was a child at the time of the marriage.\u00a0\n
                \n
              • The annulment of child marriage can be sought within two years<\/strong> after the child who was a party to the marriage had attained majority.<\/strong>\u00a0<\/li>\n<\/ul>\n<\/li>\n\n\n\n
              • Only the children <\/strong>in the marriage themselves can file a petition for voidability or annulment <\/strong>of marriage. And if the petitioner is a minor,<\/strong> the petition can be filed through a guardian or the next best friend<\/strong> of the married child (who must be an adult of 18 years or more), along with the CMPO.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"
