class=\"wp-block-heading\"><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\"><strong><strong><strong><strong><strong><strong><strong><strong>Unlawful Activities (Prevention) Act, 1967<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/mark><\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Unlawful Activities (Prevention) Act (UAPA) is <strong>anti-terrorism law <\/strong>that was first introduced in <strong>1967 <\/strong>to <strong>prevent unlawful activities associations in India<\/strong>.\u00a0\u00a0<\/li>\n\n\n\n<li>The act gives the<strong> police power to detain anyone engaging in unlawful activities <\/strong>like aiding and abetting terrorists, funding terrorists, inciting anti national feeling in the masses and other unlawful activities against the state.\u00a0\u00a0<\/li>\n\n\n\n<li>Offences under the Act shall be punishable with<strong> imprisonment for a term which shall not be less than five years <\/strong>but which may extend to<strong> imprisonment for life<\/strong>, and shall also be<strong> liable to fine.<\/strong>\u00a0<\/li>\n\n\n\n<li>The Central Government <strong>amended the Act <\/strong>in <strong>2019.<\/strong><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\"><strong><strong><strong><strong><strong><strong><strong><strong><strong>Unlawful Activities (Prevention) Amendment Act, 2019<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/mark><\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The amendment <strong>empowers the central government<\/strong> to <strong>designate an individual a \u201cterrorist<\/strong>\u201d if they are found committing, preparing for, promoting, or involved in an act of terror.\u00a0\u00a0\n<ul class=\"wp-block-list\">\n<li>Prior to this amendment, <strong>only organizations <\/strong>could be designated as terrorist organizations.\u00a0<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The amendment allows the <strong>Director-General of the <\/strong><strong>National Investigation Agency (NIA)<\/strong> to approve the <strong>seizure of property connected with terrorism.\u00a0<\/strong>\u00a0<\/li>\n\n\n\n<li>This <strong>removes the prior requirement<\/strong> for the investigating officer to obtain<strong> permission from the Director-General of Police (DGP)<\/strong> of the state.\u00a0<\/li>\n\n\n\n<li><strong>NIA officers of the rank of Inspector or higher<\/strong> are now authorized to <strong>investigate offenses<\/strong> under the UAPA.\u00a0\u00a0\n<ul class=\"wp-block-list\">\n<li>Previously, <strong>only officers of the rank of Deputy Superintendent or Assistant Commissioner of Police or above<\/strong> could do so.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\"><strong><strong><strong><strong><strong><strong><strong><strong><strong>Why in News?<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/mark><\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A tribunal under the Unlawful Activities (Prevention) Act has upheld the Union Home Ministry\u2019s decision to declare two radical organisations as \u201cunlawful associations\u201d under UAPA.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\"><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong>About UAPA Tribunals<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/mark><\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The UAPA provides for a <strong>tribunal<\/strong> to be constituted by the government for its bans to have<strong> long-term legal sanctity.<\/strong>\u00a0<\/li>\n\n\n\n<li>Orders to declare an organisation as <strong>\u201cunlawful\u201d<\/strong> are issued by the Centre under<strong> <\/strong>the <strong>UAPA.<\/strong> A <strong>government order would not come into effect until the tribunal has confirmed it.\u00a0<\/strong>\u00a0\n<ul class=\"wp-block-list\">\n<li>However, in<strong> exceptional circumstances<\/strong>, the notification can come into effect immediately once the reasons for it are recorded in writing. The tribunal can endorse or reject it.\u00a0<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The tribunal consists of <strong>only one person<\/strong>, who has to be a<strong> High Court<\/strong> judge.\u00a0<\/li>\n\n\n\n<li>To make inquiries, the tribunal has the <strong>same powers as vested in a civil court<\/strong> under the <strong>Code of Civil Procedure, 1908.<\/strong><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>UAPA Unlawful Activities (Prevention) Act, 1967 Unlawful Activities (Prevention) Amendment Act, 2019 Why in News?
