{"id":1046,"date":"2026-04-01T05:10:04","date_gmt":"2026-04-01T05:10:04","guid":{"rendered":"https:\/\/materials.simplycurrentaffairs.com\/?p=1046"},"modified":"2026-04-09T05:11:56","modified_gmt":"2026-04-09T05:11:56","slug":"central-consumer-protection-authority","status":"publish","type":"post","link":"https:\/\/materials.simplycurrentaffairs.com\/index.php\/2026\/04\/01\/central-consumer-protection-authority\/","title":{"rendered":"Central Consumer Protection Authority"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\"><strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#199668\" class=\"has-inline-color\"><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong><strong>Central Consumer Protection Authority<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/mark><\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\"><strong><strong><strong><strong><strong><strong><strong>About<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/mark><\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Central Consumer Protection Authority (CCPA) is a&nbsp;<strong>statutory body&nbsp;<\/strong>constituted under the<strong>&nbsp;Consumer Protection Act, 2019.<\/strong><\/li>\n<\/ul>\n\n\n\n<div class=\"wp-block-group border-list\"><div class=\"wp-block-group__inner-container is-layout-constrained wp-block-group-is-layout-constrained\">\n<h4 class=\"wp-block-heading\"><strong>Consumer Protection Act, 2019:<\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The&nbsp;Act&nbsp;aims to provide for&nbsp;<strong>protection of the interests of consumers<\/strong>&nbsp;and to&nbsp;<strong>establish&nbsp;authorities<\/strong>&nbsp;for&nbsp;timely&nbsp;and effective administration and settlement of consumers&#8217; disputes.&nbsp;<\/li>\n\n\n\n<li>The Act&nbsp;<strong>replaced the Consumer Protection&nbsp;Act,&nbsp;1986.<\/strong><\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><strong><strong>Key Features of the Act:<\/strong><\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Definition of consumer:&nbsp;<\/strong>A consumer is defined as a person who&nbsp;<strong>buys any good or avails a service<\/strong>&nbsp;for&nbsp;a consideration.&nbsp;It&nbsp;<strong>does not include a person who obtains a good for resale or a good or service for commercial&nbsp;purpose.\u202f<\/strong>&nbsp;<\/li>\n\n\n\n<li>It covers<strong>&nbsp;transactions through all modes&nbsp;<\/strong>including&nbsp;<strong>offline, and online through electronic means, teleshopping, multi-level&nbsp;marketing&nbsp;or direct selling.<\/strong>&nbsp;<\/li>\n\n\n\n<li>The following consumer rights have been defined in the Act, including the right to:&nbsp;\n<ul class=\"wp-block-list\">\n<li>be<strong>&nbsp;protected against<\/strong>&nbsp;the marketing of goods and services which are&nbsp;<strong>hazardous to life and property;&nbsp;<\/strong>&nbsp;<\/li>\n\n\n\n<li>be<strong>&nbsp;informed of the quality, quantity, potency, purity, standard and price<\/strong>&nbsp;of goods or services;&nbsp;&nbsp;<\/li>\n\n\n\n<li>be&nbsp;<strong>assured of access<\/strong>&nbsp;to a variety of goods or services at competitive prices; and&nbsp;&nbsp;<\/li>\n\n\n\n<li><strong>seek redressal<\/strong>&nbsp;against unfair or restrictive trade practices.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Product liability clause:&nbsp;<\/strong>A manufacturer or a service provider&nbsp;has to&nbsp;<strong>compensate&nbsp;<\/strong>a consumer if their good\/service&nbsp;cause&nbsp;injury or loss to the consumer due to&nbsp;<strong>manufacturing defect or poor service<\/strong>. The most significant impact of this provision will be on&nbsp;<strong>e-commerce<\/strong>&nbsp;<strong>platforms&nbsp;<\/strong>as it also includes service providers under its ambit.&nbsp;&nbsp;<\/li>\n\n\n\n<li><strong>Consumer Protection Councils:&nbsp;<\/strong>The Act mandates&nbsp;establishment&nbsp;of&nbsp;<strong>Consumer Protection Councils at the Centre as well as in each State and District,&nbsp;<\/strong>with a view to&nbsp;<strong>promoting consumer awareness<\/strong>.&nbsp;&nbsp;<\/li>\n\n\n\n<li>The Central Council is headed by&nbsp;<strong>Minister In-charge of the Department of Consumer Affairs&nbsp;<\/strong>in the Central Government and the State Councils by the Minister In-charge of the Consumer Affairs in the State Governments.&nbsp;&nbsp;<\/li>\n\n\n\n<li><strong>Central Consumer Protection Authority (CCPA):&nbsp;<\/strong>To be set up by the central government to&nbsp;<strong>promote, protect and enforce the rights of consumers.&nbsp;<\/strong>&nbsp;<\/li>\n\n\n\n<li><strong>Misleading advertisements:&nbsp;<\/strong>The CCPA may impose a penalty on a manufacturer or an endorser of&nbsp;<strong>up to Rs 10 lakh and imprisonment for up to two years&nbsp;<\/strong>for a false or misleading advertisement.\u202fIn case of a&nbsp;subsequent&nbsp;offence, the fine may extend to Rs 50 lakh and imprisonment of up to five years.\u202f&nbsp;<\/li>\n\n\n\n<li><strong>Consumer Disputes Redressal Commissions (CDRCs):&nbsp;<\/strong>It will be set up at the&nbsp;<strong>district, state, and national levels<\/strong>.&nbsp;A consumer can file a complaint with CDRCs in relation to:\u202f&nbsp;\n<ul class=\"wp-block-list\">\n<li>Unfair or restrictive trade practices;\u202f&nbsp;<\/li>\n\n\n\n<li>Defective goods or services;\u202f&nbsp;<\/li>\n\n\n\n<li>Overcharging or deceptive charging; and\u202f&nbsp;<\/li>\n\n\n\n<li>The offering of goods or services for&nbsp;sale which&nbsp;may be hazardous to life and safety.\u202f\u202f&nbsp;<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Appeals: Appeals from a District CDRC&nbsp;<\/strong>will be heard by the&nbsp;<strong>State CDRC.&nbsp;<\/strong>Appeals from the State CDRC will be heard by the&nbsp;<strong>National CDRC.<\/strong>\u202fFinal appeal will lie before the&nbsp;<strong>Supreme Court.<\/strong>&nbsp;<\/li>\n\n\n\n<li><strong>Alternate Dispute Resolution through Mediation:&nbsp;<\/strong>The Act has introduced the provision where the relevant Commission can<strong>&nbsp;refer&nbsp;a consumer dispute for mediation<\/strong>, when there is a scope of settlement between the parties.<\/li>\n<\/ul>\n<\/div><\/div>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The CCPA&nbsp;<strong>aims to protect the rights of the consumer&nbsp;<\/strong>by&nbsp;cracking down&nbsp;on unfair trade practices, and false and misleading advertisements that are detrimental to the interests of the public and consumers.&nbsp;<\/li>\n\n\n\n<li>The CCPA is&nbsp;<strong>empowered to conduct investigations<\/strong>&nbsp;into violation of consumer rights and institute complaints\/prosecution,&nbsp;<strong>order recall<\/strong>&nbsp;of unsafe goods and services,&nbsp;<strong>order discontinuation<\/strong>&nbsp;of unfair trade practices and misleading advertisements,&nbsp;<strong>impose penalties<\/strong>&nbsp;on manufacturers\/endorsers\/publishers of misleading advertisements.&nbsp;<\/li>\n\n\n\n<li>It functions under the&nbsp;<strong>Ministry of Consumer Affairs.<\/strong>&nbsp;&nbsp;<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Central Consumer Protection Authority About Consumer Protection Act, 2019: Key Features of the Act:<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[44],"tags":[],"class_list":["post-1046","post","type-post","status-publish","format-standard","hentry","category-organisations"],"_links":{"self":[{"href":"https:\/\/materials.simplycurrentaffairs.com\/index.php\/wp-json\/wp\/v2\/posts\/1046","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/materials.simplycurrentaffairs.com\/index.php\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/materials.simplycurrentaffairs.com\/index.php\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/materials.simplycurrentaffairs.com\/index.php\/wp-json\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/materials.simplycurrentaffairs.com\/index.php\/wp-json\/wp\/v2\/comments?post=1046"}],"version-history":[{"count":3,"href":"https:\/\/materials.simplycurrentaffairs.com\/index.php\/wp-json\/wp\/v2\/posts\/1046\/revisions"}],"predecessor-version":[{"id":1049,"href":"https:\/\/materials.simplycurrentaffairs.com\/index.php\/wp-json\/wp\/v2\/posts\/1046\/revisions\/1049"}],"wp:attachment":[{"href":"https:\/\/materials.simplycurrentaffairs.com\/index.php\/wp-json\/wp\/v2\/media?parent=1046"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/materials.simplycurrentaffairs.com\/index.php\/wp-json\/wp\/v2\/categories?post=1046"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/materials.simplycurrentaffairs.com\/index.php\/wp-json\/wp\/v2\/tags?post=1046"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
