  • The Central Consumer Protection Authority (CCPA) is a statutory body <\/strong>constituted under the Consumer Protection Act, 2019.<\/strong><\/li>\n<\/ul>\n\n\n\n
    \n

    Consumer Protection Act, 2019:<\/strong><\/h4>\n\n\n\n
      \n
    • The Act aims to provide for protection of the interests of consumers<\/strong> and to establish authorities<\/strong> for timely and effective administration and settlement of consumers’ disputes. <\/li>\n\n\n\n
    • The Act replaced the Consumer Protection Act, 1986.<\/strong><\/li>\n<\/ul>\n\n\n\n

      Key Features of the Act:<\/strong><\/strong><\/h4>\n\n\n\n
        \n
      • Definition of consumer: <\/strong>A consumer is defined as a person who buys any good or avails a service<\/strong> for a consideration. It does not include a person who obtains a good for resale or a good or service for commercial purpose.\u202f<\/strong> <\/li>\n\n\n\n
      • It covers transactions through all modes <\/strong>including offline, and online through electronic means, teleshopping, multi-level marketing or direct selling.<\/strong> <\/li>\n\n\n\n
      • The following consumer rights have been defined in the Act, including the right to: \n
          \n
        • be protected against<\/strong> the marketing of goods and services which are hazardous to life and property; <\/strong> <\/li>\n\n\n\n
        • be informed of the quality, quantity, potency, purity, standard and price<\/strong> of goods or services;  <\/li>\n\n\n\n
        • be assured of access<\/strong> to a variety of goods or services at competitive prices; and  <\/li>\n\n\n\n
        • seek redressal<\/strong> against unfair or restrictive trade practices.<\/li>\n<\/ul>\n<\/li>\n\n\n\n
        • Product liability clause: <\/strong>A manufacturer or a service provider has to compensate <\/strong>a consumer if their good\/service cause injury or loss to the consumer due to manufacturing defect or poor service<\/strong>. The most significant impact of this provision will be on e-commerce<\/strong> platforms <\/strong>as it also includes service providers under its ambit.  <\/li>\n\n\n\n
        • Consumer Protection Councils: <\/strong>The Act mandates establishment of Consumer Protection Councils at the Centre as well as in each State and District, <\/strong>with a view to promoting consumer awareness<\/strong>.  <\/li>\n\n\n\n
        • The Central Council is headed by Minister In-charge of the Department of Consumer Affairs <\/strong>in the Central Government and the State Councils by the Minister In-charge of the Consumer Affairs in the State Governments.  <\/li>\n\n\n\n
        • Central Consumer Protection Authority (CCPA): <\/strong>To be set up by the central government to promote, protect and enforce the rights of consumers. <\/strong> <\/li>\n\n\n\n
        • Misleading advertisements: <\/strong>The CCPA may impose a penalty on a manufacturer or an endorser of up to Rs 10 lakh and imprisonment for up to two years <\/strong>for a false or misleading advertisement.\u202fIn case of a subsequent offence, the fine may extend to Rs 50 lakh and imprisonment of up to five years.\u202f <\/li>\n\n\n\n
        • Consumer Disputes Redressal Commissions (CDRCs): <\/strong>It will be set up at the district, state, and national levels<\/strong>. A consumer can file a complaint with CDRCs in relation to:\u202f \n
            \n
          • Unfair or restrictive trade practices;\u202f <\/li>\n\n\n\n
          • Defective goods or services;\u202f <\/li>\n\n\n\n
          • Overcharging or deceptive charging; and\u202f <\/li>\n\n\n\n
          • The offering of goods or services for sale which may be hazardous to life and safety.\u202f\u202f <\/li>\n<\/ul>\n<\/li>\n\n\n\n
          • Appeals: Appeals from a District CDRC <\/strong>will be heard by the State CDRC. <\/strong>Appeals from the State CDRC will be heard by the National CDRC.<\/strong>\u202fFinal appeal will lie before the Supreme Court.<\/strong> <\/li>\n\n\n\n
          • Alternate Dispute Resolution through Mediation: <\/strong>The Act has introduced the provision where the relevant Commission can refer a consumer dispute for mediation<\/strong>, when there is a scope of settlement between the parties.<\/li>\n<\/ul>\n<\/div><\/div>\n\n\n\n

            • The CCPA aims to protect the rights of the consumer <\/strong>by cracking down on unfair trade practices, and false and misleading advertisements that are detrimental to the interests of the public and consumers. <\/li>\n\n\n\n
            • The CCPA is empowered to conduct investigations<\/strong> into violation of consumer rights and institute complaints\/prosecution, order recall<\/strong> of unsafe goods and services, order discontinuation<\/strong> of unfair trade practices and misleading advertisements, impose penalties<\/strong> on manufacturers\/endorsers\/publishers of misleading advertisements. <\/li>\n\n\n\n
